Filing an Appeal

View the steps on how an appeal is filed with the Board of Appeals.

  • Hearings are usually scheduled three times per week: on Tuesdays, Wednesdays and Thursdays, all at 5:00 p.m. Only one case is heard at each hearing. 
  • Hearings are held in the Arundel Center at 44 Calvert Street, Annapolis, MD 21401 in Council Chambers or Room 160. 
  • The Board meets for approximately three (3) hours per hearing.
  • Appeals may be mailed or hand-delivered to the office, or placed in the dropbox located outside of the Arundel Center lobby. Appeals must be received in the office within 30 days of the date of the decision being appealed.

  1. Time for Filing

    Most appeals must be filed within 30 calendar days of the date of the County’s decision. It is your responsibility to check the County Code for the specific deadlines applicable to your appeal.

    Please make your check/money order payable to Anne Arundel County.

    Reclassifications, Special Exceptions and Grading Permits$400.00
    Variances and All Other Administrative Appeals *$250.00

    * Administrative appeals include, but are not limited to, decisions of Animal Services, Office of Personnel, Permit Application Center, e.g. building permits, Office of Planning and Zoning, e.g. modifications, nonconforming uses, twenty-year registered uses, Site Development Plans, Preliminary Plans, Final Plats, and other decisions.

  4. County Agency’s Written Decision

    (must be filed at the time of appeal)

  5. List of Property Owners

    (must be filed at the time of appeal)

    The property owners list must be submitted at the time you file your appeal (excluding cases appealed from the Administrative Hearing Officer, Personnel, and Animal Services).  Property owners' names and addresses can be obtained by using the Community Meetings Property Details Viewer.

    List of names and addresses of all property owners who own land:

    1. located within 300 ft (or 175 ft) of the affected property;
    2. that confronts or adjoins the affected property; and
    3. except property owned by government entities or public service companies, that confronts or adjoins land identified in (2) above.

    Use the Property Details Viewer to generate a list of nearby property owners:

    In the Public Notification box start typing the address or tax ID number (12 digits)

    Click the box beside “Apply a search distance”

    Verify or enter the search distance required (175 feet or 300 feet)

    Change the Format to “PDF label 1 x 4 inches; 20 per page”

    Click Download button (a PDF of the properties within the specified distance will be generated)

  6. Councilmanic District Number

    (must be filed at the time of appeal)

    This information must be submitted at the time you file your appeal. Use the "Who is my Councilmember?" lookup tool to locate the district number. If you have difficulty, call the County Council office at (410) 222-1401 with the street address of the subject property.
