The Department of Inspections and Permits Requires Development Projects Ensure Compliance with Americans with Disabilities Act (ADA) Accessibility Standards

Background 

The Federal Government’s revised regulations for Titles II and III of the Americans with Disabilities Act of 1990 (ADA) were published in the Federal Register on September 15, 2010. These regulations adopted revised, enforceable accessibility standards called the 2010 ADA Standards for Accessible Design, "2010 Standards." On March 15, 2012, compliance with the 2010 Standards was required for new construction and alterations under Titles II and III. March 15, 2012, is also the compliance date for using the 2010 Standards for program accessibility and barrier removal. 

 

Purpose 

Anne Arundel County is committed to ensure compliance with the Americans with Disabilities Act (ADA). The purpose of this memo is to provide notice that compliance with ADA accessibility standards for development projects- concept through construction is required. The development community should continue due diligence in formulation and presentation of plans that include compliance with ADA standards. Enhanced attention to this level of detail will serve to assist plan reviewers and field inspectors to forward proposed plans that will result in finished development projects that will have compliance with ADA standards. 

 

Project Submittals – Accessibility Standards 

Project submittals must present plans to include building and site access features that strictly comply with ADA Standards. The Department of Inspections and Permits is committed to performing detailed reviews of plans presented by Developers or their representatives with regard to vehicular and pedestrian access with particular attention to compliance with ADA standards. 

Beginning May 1, 2021, the Department of Inspections and Permits will require the design professional in responsible charge to provide Statement of Accessibility Review on the cover page of every plan submittal for the following permit types: 

  1. All grading permits which include site improvements. ADA Accessibility Standards – Development Projects April 9, 2021 
  2. Building permits - all commercial and residential new construction, additions, interior alteration and where required by International Existing Building Code (IEBC) due to upgrades. Single family dwelling units, duplex or townhomes are excluded.

Statement of Accessibility Review

I hereby certify that these plans have been designed in conformance with the 2010 ADA Standards for Accessible Design, County Code, Maryland Accessibility Code and Accessible and Useable Buildings and Facilities - ICC A117.1- 2009 standard.
