                ADMINISTRATIVE HEARINGS        EIGHTH ASSESSMENT DISTRICT

                      SHOW CAUSE ORDER          CASES NO. V67-67 & S68-67 

      The applicants, Tracy Garrett and Earthreports, Inc., d/b/a/ Patuxent Riverkeeper (Petitioners), have filed a Motion to Rescind or Modify the Special Exception granted in Case No. V67-67 and Case No. S68-67 (the 1967 Special Exceptions) to have Belle Grove Corporation (Respondent), the current property owner of real property (the Respondent’s Property) located at 4944 Ed Prout Road, Lothian, Maryland, Tax Account No. 8000-0004 7600 consisting of 109.4 acres, more or less, and have requested that a show cause order be issued as to why the special exception granted in the 1967 Special Exceptions be rescinded or modified; and
      Whereas, the Petitioners have sufficiently alleged that the Respondent’s Property may not be in compliance with the uses approved in the 1967 Special Exceptions; and Whereas, the Petitioners have shown that they are or may be aggrieved parties as defined in § 18-16-404(a); and Whereas, Anthony G. Gorski, Esquire, has indicated that he represents Respondent; and

      Whereas, § 18-16-404 of the Anne Arundel County Code gives this Office the authority to rescind, suspend, or modify a variance as set forth below (emphasis supplied):
      (a) Grounds. On motion of the County or an aggrieved party, or on the Administrative Hearing Officer's own initiative, approval of an application for a rezoning, variance or special exception shall be rescinded, suspended, or modified if the Administrative Hearing Officer determines, after a hearing, that:
      (1) the approval or grant was based on a fraudulent misrepresentation of material information in the application, testimony, administrative site plan, or other supporting documents; or
      (2) the use of the property deviates from the approved administrative site plan, an allowed use under the rezoning, or any conditions imposed.
      (b) Effect of rescission. If a rezoning, variance or special exception is rescinded, the use of the property shall comply with the zoning uses and regulations permitted for the property prior to the grant of rezoning, variance or
      special exception.
