County Receives Settlement From Class Action Lawsuit

Annapolis, Md. (July 23, 2013) – Anne Arundel County has received $365,886.26 – its share of an $82 million settlement of a class-action lawsuit involving an alleged conspiracy to inflate the price of public employee prescription drugs.

 

 “We are pleased with the resolution of this case,” said County Executive Neuman. “We will do anything we need to do to protect the interest of our employees. I hope this settlement sends a clear message to companies like this that we will pursue illegal practices to the fullest extent of the law. I commend our offices of Law and Personnel for their diligence in seeing this lawsuit to its end.”

 

The case, McKesson Governmental Entities Average Wholesale Price Litigation, was filed in U.S. District Court in Boston and claimed that a drug wholesaler and the publisher of drug data conspired to mark up the average wholesale price for certain pharmaceutical drugs, including those covered by benefits plans for County employees.

 

The County joined the class-action suit and submitted a claim in February of 2012. The county alleged prices were inflated for a list of the prescription drugs between April of 2005 and October of 2006. The amount of the County’s share of the settlement was calculated by multiplying the total amount paid for the drugs during that time by four percent.
